Terms of Service

By creating an account or using any Filowise service at app.filowise.com, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

Filowise provides the following services:

• Self-serve IRS tax form preparation (W-9, W-8BEN, W-8BEN-E) — you fill out a guided form and receive a completed PDF
• Expert-assisted form preparation (Form 8832, Form 8822-B, W-8BEN-E Expert) — a tax specialist prepares the form on your behalf
• W-9 and W-8 collection links — tools to collect completed forms from contractors
• Developer API and MCP server for programmatic form generation

Filowise is a technology platform, not a licensed tax advisor, CPA firm, attorney, or financial advisor. Our experts assist with form preparation only. They do not provide tax planning advice, represent you before the IRS, or guarantee any particular tax outcome.

You are solely responsible for the accuracy of information you provide. Filowise is not liable for penalties, interest, or other consequences arising from incorrect information submitted by you.

You must be at least 18 years old to create an account. You are responsible for maintaining the security of your account credentials. You agree not to share your account with others or use another person's account.

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or misuse our platform.

All prices are listed in USD. Payments are processed by Dodo Payments. By completing a purchase you agree to Dodo Payments' terms.

Self-serve form purchases are charged at the time of purchase. Expert-assisted requests are charged at the time of submission. Enterprise plan customers are billed monthly in arrears based on actual usage — see the Enterprise Agreement for details.

All prices are exclusive of applicable taxes. Dodo Payments, as our Merchant of Record, handles VAT, GST, and sales tax collection where required.

You agree not to:

• Use Filowise to prepare forms containing knowingly false information
• Attempt to reverse-engineer, scrape, or extract data from our platform
• Use our API or MCP server in violation of our API terms
• Resell or redistribute our form outputs without authorisation
• Use our platform for any unlawful purpose

The Filowise platform, brand, software, and documentation are owned by Filowise and protected by applicable intellectual property laws. IRS form templates are public domain. Completed PDF outputs you generate belong to you.

To the maximum extent permitted by law, Filowise's total liability for any claim arising from your use of our services is limited to the amount you paid to Filowise in the 12 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or IRS penalties regardless of how they arise.

Filowise is provided "as is" without warranties of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or that completed forms will be accepted by the IRS in every case.

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India. If you are a consumer in the EU or UK, mandatory consumer protection laws in your jurisdiction also apply.

We may update these terms from time to time. Continued use of Filowise after changes are posted constitutes acceptance. We will provide notice of material changes by email or in-app notification.
